What You Should Know about Asbestos Claims 27/7/2010

Asbestos is a natural mineral known for its distinct qualities, which makes it a suitable component in commercial and chemical constructions.  It has been highly regarded as an essential material for construction due to its ability to resist high temperature, absorb sound, and act as insulation against electricity. It has tensile strength that enables one to flex it, mold it and form into different shapes. No wonder most companies prefer to use asbestos regardless of its harmful effects.

 

Being exposed to asbestos can cause serious health problems that could possibly be fatal. Its fibers are airborne and can easily be inhaled. Since the fibers are bigger, the lungs cannot expel them. In addition, the symptoms of asbestos-related diseases don’t occur noticeably. It would take years to realize they have been hit by the disease and sometimes, it’s already too late.

 

There are different types of asbestos related diseases. The most commonly known is Mesothelioma, which develops in the linings of the lungs (pleura). Others include lung cancer, asbestosis, pleural thickening, pleural plaques and some visible skin diseases such as asbestos warts.

 

Due to these life-threatening dangers, Asbestos claims have been legally provided to workers whose health is at risk. It goes back to the 1960s when lawsuits were filed against asbestos manufacturers. Since then, more and more people have decided to take legal actions toward the companies that allow their employees to have contact with asbestos.

Asbestos claimshave a general rule that the litigation  should start 3 years from the time a victim has been diagnosed with an asbestos related disease. It is only for special cases that a court could allow someone to go beyond 3 years.

 

Withasbestos claims, avictim or a family member could reimburse whatever medical expenses he or she had to spend during the time of battling asbestos related diseases.  It can help them recover from financial damages such as unpaid salaries and other medical needs. However, the claim may take time depending on the seriousness of the disease. Some people say that judges show a little more sympathy to serious victims so they exert more effort to make the litigation process faster.  The amount of compensation for asbestos claims also depends on several factors such as the type of the disease, the degree of its seriousness, the financial loss and the necessary medical treatments.
